To determine the amount you will receive in settlement please refer to the schedule attached to the settlement agreement. However, please be aware that the amount will be reduced. It has subsequently been discovered that a large provider was omitted from the list. Also, this firm has applied for its attorney’s fees and costs to be paid . This amount will be applied prorata to reduce the award. If any of you have any questions, please feel free to email me. I will post responses on this web page to share with all other class members.

Many of you have received the notice of the class action and are asking what you need to do. If you want to participate in the settlement you don't need to do anything. Please do not sign any of the paperwork you received or otherwise send in anything. Only if you object to the settlement or do not want to participate are you required to file any documents.

The settlement is scheduled for a hearing to determine whether it is approved on June 19. If the settlement is approved the settlement will be funded during the following 90 days. Therefore, checks will be issued no later than September 19. The check will be a net check after deduction of this firm's attorney's fees and costs.

The payout schedule adjusted for previously omitted class members is now available. Look in the file 06-5-5 Amendment to Settlement Agreement.pdf. Please remember there will be a deduction against that amount for this firm's attorney fee award. The amount will be prorated in the same manner as the settlement amount.
Name: Recission of Erroneous Opt Out

A very small number of you, may have signed the Opt Out that was provided with the original notice. In order to receive a payment you will need to rescind the previous form you sent. The form title "06-6-1 Corrective Notice" needs to be signed and mailed by you.

I am happy to report that the class action settlement is approved. Below is a copy of the order approving the settlement. I anticipate that disbursement of the funds should occur in September 2006. This firm's attorney's fees will be deducted pro rata from everyone's payment amounts.

The funds were not delivered to our office until after 2:00 Pm on August 25th. Therefore we could not deposit them until August 28th, and our bank has indicated that we should allow five business days before we can have cleared funds.
